The Question
Assalamu
Alaikum, Sheikh.
A man requested intimacy with his wife in accordance with Islamic teachings, but she refused. He eventually forced himself on her, and after they had finished, he instructed her not to wear any clothes until he woke up from sleep. However, he slept until morning. When he woke up, he found her dressed and asked why she had put her clothes on. She explained that she had performed her prayers, but she had not woken him up to pray.
What is the
Islamic ruling on this situation? Thank you, Sheikh.

Answer
Wa Alaikum
Assalam wa Rahmatullahi wa Barakatuh.
Islam establishes
rights and responsibilities between husbands and wives. However, these rights
must be understood alongside the principles of mercy, kindness, mutual respect,
and obedience to Allah.
This question
involves three separate matters: marital intimacy, the husband's treatment of
his wife, and the obligation to perform prayer.
1.
The Rights of Spouses Regarding Marital Intimacy
Islam recognises
that intimacy is one of the purposes of marriage and that spouses have
responsibilities towards one another. Both husband and wife should make
reasonable efforts to maintain a healthy marital relationship, communicate
their needs, and avoid deliberately neglecting one another's legitimate rights.
The Prophet
Muhammad (peace and blessings be upon him) said:
Transliteration:
Idhā daʿā
al-rajulu imra'atahu ilā firāshihi fa-abat, fa-bāta ghaḍbāna ʿalayhā, laʿanathā
al-malā'ikatu ḥattā tuṣbiḥ.
English
translation:
“When a man calls
his wife to his bed and she refuses, and he spends the night angry with her,
the angels curse her until morning.”
Reference: Sahih al-Bukhari 3237 and Sahih Muslim
1436.
Scholars discuss
this hadith alongside the circumstances in which a wife may have a legitimate
reason to decline intimacy. Illness, pain, menstruation, fear of harm, and
other valid circumstances must be considered. The hadith should not be used to
dismiss genuine hardship or to justify mistreatment.
2.
Does a Husband Have the Right to Force His Wife?
A husband's
marital rights do not give him permission to cause harm or treat his wife with
cruelty. The principle of living together in kindness applies to
marriage, including its intimate aspects.
Allah says:
Arabic:
وَعَاشِرُوهُنَّ
بِالْمَعْرُوفِ
Transliteration:
Wa
ʿāshirūhunna bil-maʿrūf.
English
translation:
“Live with them in
kindness.”
Reference: Qur'an 4:19.
The Prophet (peace
and blessings be upon him) also said:
Arabic:
لَا ضَرَرَ وَلَا ضِرَارَ
Transliteration:
Lā ḍarar wa lā
ḍirār.
English
translation:
“There should be
neither harm nor reciprocating harm.”
Reference: Sunan Ibn Majah 2340; the hadith is widely accepted
as an important legal principle.
Therefore, a
husband should not use physical force, intimidation, or coercion to obtain
intimacy. If his wife repeatedly declines, he should seek to understand the
reason, communicate calmly, and pursue reconciliation rather than resorting to
force.
Likewise, a wife
should communicate her concerns honestly and, where possible, work with her
husband to address difficulties in their relationship.
If there is
persistent conflict, a trustworthy counsellor or qualified religious adviser
may help the couple find a safe and respectful way forward. Where violence or
coercion occurs, the affected spouse's safety must take priority.
3.
Was the Wife Wrong to Put Her Clothes On?
The husband
instructed his wife not to wear clothes until he woke up, but she dressed
before he awoke because she wanted to perform her prayers.
A husband's
instruction cannot override an obligation established by Allah. A wife is not
required to obey a command that conflicts with her religious obligations.
Moreover, there is
no general Islamic rule requiring a wife to remain unclothed merely because her
husband instructed her to do so while he slept.
Consequently,
dressing to prepare for prayer is not, in itself, an act of disobedience to her
husband. The husband should not treat this as a justification for anger or
punishment.
4.
What About the Husband's Prayer?
If the husband
slept through the time of an obligatory prayer, he should perform it when he
wakes up. The Prophet Muhammad (peace and blessings be upon him) said that
whoever forgets a prayer or sleeps through it should pray when they remember
it.
Reference: Sahih al-Bukhari 597 and Sahih Muslim
684.
The husband should
therefore take responsibility for his own prayer. He may ask his wife to help
wake him when appropriate, but he remains responsible for making reasonable
efforts to fulfil his religious obligations.
5.
How Should the Couple Resolve the Matter?
Both spouses
should reflect on their responsibilities and seek to restore trust and
understanding.
The husband should
avoid force and intimidation, treat his wife with kindness, and recognise that
marital life is not meant to be governed by threats or unilateral commands.
The wife should
communicate her needs and concerns openly and, where circumstances permit,
cooperate with her husband in maintaining their relationship.
If the incident
involved force or fear, the couple should not minimise it as an ordinary
disagreement. The wife should be able to seek confidential support and
protection if needed.
Conclusion
Islam recognises
the rights of spouses to marital intimacy, but these rights must be understood
within the wider framework of kindness, responsibility, and the prohibition of
harm.
A husband should
not force his wife into intimacy or use his position to intimidate her. A wife
is not required to obey a command that conflicts with an obligation to Allah,
and a husband remains responsible for his own prayers.
The best course is
to abandon coercion, communicate with respect, and seek qualified assistance
when necessary.
May Allah guide
both spouses, improve their relationship, and enable them to live together with
mercy, tranquillity, and mutual respect.
