A woman asks:
“There are frequent disagreements between me and my
husband. Sometimes, because of something he does that hurts me, I tell him,
‘Allah sees everything you do.’ He interprets this as though I am saying,
‘Allah will deal with you’ or ‘Allah is enough for me against you.’ He has even
told me that if I ever say it again, we will be permanently separated.
Sometimes he does things that hurt me, but I keep quiet
and think about them in my heart. I may then say, ‘Allah sees everything,’
because Allah knows what is happening and He will give me justice.
What is the Islamic ruling concerning my statement? Does saying, ‘Allah sees everything you do,’ constitute divorce?”
ANSWER ❗️
Wa Alaikumussalam wa Rahmatullahi wa Barakatuh.
There is an important distinction between expressing
a complaint to Allah or reminding someone that Allah knows what they are doing
and uttering words of divorce (ṭalāq).
If the wife says to her husband:
“Allah sees everything you do,”
while intending that Allah knows what is
happening between them and knows the harm or difficulty she is experiencing,
this statement is not itself a divorce.
Likewise, if she says words such as:
“Allah sees what is happening, and He will deal with it,”
this does not automatically constitute ṭalāq. Such words
can simply mean that she is entrusting her grievance to Allah and affirming
that nothing is hidden from Him.
Allah says:
إِنَّ اللَّهَ كَانَ
عَلَيْكُمْ رَقِيبًا
Inna Allāha kāna ʿalaykum raqībā.
“Indeed, Allah is ever Watchful over you.”
— Qur’an 4:1
Therefore, merely saying that Allah sees what is
happening is not a formula of divorce.
What About Saying “Allah Will Give Me
Justice”?
If a woman says:
“Allah will give me justice,”
or:
“Allah is sufficient for me; He knows what is happening,”
this is likewise not, by itself, a declaration of
divorce.
A person who has been wronged is permitted to complain to
Allah and ask Him for justice. Allah says:
لَا يُحِبُّ اللَّهُ
الْجَهْرَ بِالسُّوءِ مِنَ الْقَوْلِ إِلَّا مَن ظُلِمَ
Lā yuḥibbu Allāhu al-jahra bis-sū’i mina al-qawli illā
man ẓulim.
“Allah does not like the public mention of evil except by
one who has been wronged.”
— Qur’an 4:148
However, spouses should still avoid using threatening or
inflammatory language during arguments and should seek reconciliation whenever
possible.
What About the Husband Saying, “If You Say It
Again, We Are Separated”?
This part of the question is different because the husband's
statement concerns divorce or separation.
If he says something such as:
“If you say that again, we are separated,”
the exact wording becomes important.
Statements concerning future divorce can fall under
different categories depending on the words used, the circumstances and, in
some cases, the husband's intention. Therefore, it would not be appropriate to
declare from this description alone that divorce has occurred—or that it
certainly has not occurred.
For example, there is a significant difference between
saying:
“I will divorce you if you say that again,”
and saying:
“If you say that again, you are divorced.”
The legal consequences may differ.
Therefore, if the husband has actually used a conditional
divorce statement, the couple should write down his exact words,
in the original language in which he said them, and present them to a qualified
scholar or mufti who can examine the matter carefully.
The Wife's Words Do Not Automatically Trigger
Divorce
It is also important to understand that the husband's
statement does not transform every subsequent statement by his wife into
divorce.
If he has said, for example:
“If you say that again, we are separated,”
then the precise wording and legal effect of that
statement must first be determined.
The wife saying:
“Allah sees everything you do”
does not itself become a divorce simply because the
husband interprets it as meaning “Allah will deal with you.”
A person's interpretation of another person's words does
not by itself turn those words into ṭalāq.
The actual words, their context and, where relevant, the
husband's intention must be considered.
A Word of Advice to Both Spouses
Even though the wife's statement is not itself a divorce,
both spouses should avoid language that unnecessarily escalates conflict.
If one spouse feels hurt, it is better to communicate the
specific problem calmly rather than allowing resentment to accumulate.
Likewise, a husband should not repeatedly threaten his wife with divorce during
arguments.
Allah says:
وَعَاشِرُوهُنَّ
بِالْمَعْرُوفِ
Wa ʿāshirūhunna bil-maʿrūf.
“And live with them in kindness.”
— Qur’an 4:19
When disagreements become persistent, the Qur'an
recommends reconciliation and mediation:
وَإِنْ خِفْتُمْ
شِقَاقَ بَيْنِهِمَا فَابْعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا
Wa in khiftum shiqāqa baynihimā fabʿathū ḥakaman min
ahlihi wa ḥakaman min ahlihā.
“If you fear a breach between them, appoint one mediator
from his family and one mediator from her family.”
— Qur’an 4:35
Conclusion
Saying “Allah sees everything you do” is
not a statement of divorce. If the wife means that Allah knows
what her husband is doing and knows the difficulties she is experiencing, there
is nothing in those words that constitutes ṭalāq.
Similarly, saying “Allah will give me justice”
or entrusting one's grievance to Allah does not automatically end a marriage.
However, if the husband has made a conditional
statement involving divorce or separation, his exact words should be
examined carefully by a qualified scholar, because the legal ruling depends on
the wording, circumstances and, where relevant, intention.
