The Islamic Ruling on Marriage Between a Maternal Aunt’s Nephew and a Maternal Aunt’s Niece

Question

Assalamu Alaikum wa Rahmatullahi wa Barakatuh,

May Allah, the Almighty, grant you good health, a blessed long life, and steadfastness in faith. Please, I would like to ask: Is marriage permissible between a man who is the son of one’s maternal aunt and a woman who is the daughter of another maternal aunt? Thank you.

Answer

Wa Alaikumus Salam wa Rahmatullahi wa Barakatuh.

Marriage between a man who is the son of one maternal aunt and a woman who is the daughter of another maternal aunt is permissible in Islam, provided there is no other Islamic legal impediment to the marriage, such as a breastfeeding relationship that establishes a prohibited degree of kinship.

The reason is that cousins are not among the relatives whom Allah has permanently forbidden a person to marry.

Evidence from the Qur’an

Allah, the Most High, explains the categories of women forbidden in marriage in Surah An-Nisa:

English translation:

“Forbidden to you [for marriage] are your mothers, your daughters, your sisters, your paternal aunts, your maternal aunts, your brother’s daughters, your sister’s daughters, your foster mothers who nursed you, and your foster sisters…”

— Qur’an 4:23

This verse identifies the categories of relatives whom Allah has forbidden a person to marry, including mothers, daughters, sisters, paternal and maternal aunts, nieces, and certain relatives through breastfeeding.

However, cousins are not included among these prohibited categories. Therefore, marriage between cousins is permissible in principle.

What if They Are Related Through Breastfeeding?

Although marriage between cousins is generally permissible, the ruling may change if the two individuals have a breastfeeding relationship that establishes prohibited kinship under Islamic law.

The Prophet Muhammad (peace and blessings be upon him) said:

“What becomes prohibited through breastfeeding is what becomes prohibited through lineage.”

— Sahih al-Bukhari and Sahih Muslim

Therefore, if breastfeeding has established a relationship that prohibits marriage between them, they cannot marry one another.

Are They Mahram to Each Other Before Marriage?

No. Cousins are generally not mahrams to one another. Consequently, the Islamic rules governing interaction between a man and a woman who are not mahrams apply to them before marriage.

The fact that they are cousins does not remove the relevant boundaries of interaction prescribed by Islam.

Conclusion

Marriage between a man who is the son of one maternal aunt and a woman who is the daughter of another maternal aunt is permissible in Islam, provided no other legal impediment exists, particularly one arising from breastfeeding or another prohibited relationship.
