It is surprising how most people's attention has not focused on the motion that Hon. Bappa Aliyu Misau presented in the National Assembly. This is an extremely important motion for this Muslim-Muslim Government. Unfortunately, the motion was dismissed on its first presentation. And now, silence as if it never happened.
The motion aims at a significant amendment for the
Sharia Courts, because even within the Constitution, there is justification for
it.
The essence of the motion is to remove the
limitations placed on Sharia law in Sharia Courts, where it is currently
restricted to matters labeled “Personal.” The member of the Assembly
representing Misau/Dambam constituency proposed to remove the term “Personal”
and change the designation from “Islamic Personal Law” to “Islamic Law.” This
change would allow Sharia Courts to apply Islamic legal principles to
Muslim-related matters, including business and other daily affairs, beyond just
personal issues.
This matter affects only Muslims, and the national
law allows everyone the right to be judged according to the laws of their
religion or culture.
Securing the approval and success of this motion
would surely strengthen the trust placed in a Muslim-Muslim Government.
Last year, we visited a Grand Khadi who lamented
this same issue, stating that their jurisdiction in Sharia Courts is tightly
restricted to only “Personal Law” (الأحوال الشخصية). He
expressed deep concern over this.
In any case, this is a major challenge for the
Muslim community, especially for their influential organizations capable of
lobbying the government and Assembly members. Muslim organizations should not
overlook such crucial tasks. If they are indeed trying their best on this
matter, they should not remain silent toward those who criticize the motion in
newspapers. This has led the Assembly member to face accusations—as if he
intends to “Islamize” Nigeria.
We pray for the Assembly member Hon. Bappa Aliyu
Misau. May Allah reward him with goodness and assist him in his noble goals.
