A Muslim Woman is Not Permitted to Remain Married to a Non-Muslim Man

If a Muslim husband leaves Islam and becomes a Christian while his wife remains Muslim, what happens to the marriage and what rights does he still have as a husband?

In Islam, faith is a fundamental consideration in marriage. If a Muslim husband deliberately leaves Islam and adopts another religion, such as Christianity, while his wife remains a Muslim, this creates a serious legal consequence for the marriage. A Muslim woman is not permitted to remain in a marital relationship with a non-Muslim man.

Allah says concerning believing women:

Arabic:
يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا جَاءَكُمُ الْمُؤْمِنَاتُ مُهَاجِرَاتٍ فَامْتَحِنُوهُنَّ ۖ اللَّهُ أَعْلَمُ بِإِيمَانِهِنَّ ۖ فَإِنْ عَلِمْتُمُوهُنَّ مُؤْمِنَاتٍ فَلَا تَرْجِعُوهُنَّ إِلَى الْكُفَّارِ ۖ لَا هُنَّ حِلٌّ لَهُمْ وَلَا هُمْ يَحِلُّونَ لَهُنَّ ۖ وَآتُوهُمْ مَا أَنْفَقُوا ۚ وَلَا جُنَاحَ عَلَيْكُمْ أَنْ تَنْكِحُوهُنَّ إِذَا آتَيْتُمُوهُنَّ أُجُورَهُنَّ ۚ وَلَا تُمْسِكُوا بِعِصَمِ الْكَوَافِرِ وَاسْأَلُوا مَا أَنْفَقْتُمْ وَلْيَسْأَلُوا مَا أَنْفَقُوا ۚ ذَٰلِكُمْ حُكْمُ اللَّهِ ۖ يَحْكُمُ بَيْنَكُمْ ۗ وَاللَّهُ عَلِيمٌ حَكِيمٌ

Transliteration:
Yā ayyuhā alladhīna āmanū idhā jā’akumu al-mu’minātu muhājirātin fa-imta
ḥinūhunna, Allāhu aʿlamu bi-īmānihinna, fa-in ʿalimtumūhunna mu’mināti fa-lā tarjiʿūhunna ilā al-kuffār, lā hunna ḥillun lahum wa-lā hum yaḥillūna lahunna, wa-ātūhum mā anfaqū, wa-lā junāḥa ʿalaykum an tankiḥūhunna idhā ātaytumūhunna ujūrahunna, wa-lā tumsikū bi-ʿiṣami al-kawāfiri was’alū mā anfaqtum wa-l-yas’alū mā anfaqū, dhālikum ḥukmu Allāh, yaḥkumu baynakum, wa-Allāhu ʿalīmun ḥakīm.

English translation:
“O you who have believed, when the believing women come to you as emigrants, examine them. Allah is most knowing as to their faith. And if you know them to be believers, then do not return them to the disbelievers; they are not lawful [wives] for them, nor are they lawful [husbands] for them. And give them what they have spent [of their bridal gifts]. And there is no blame upon you if you marry them when you have given them their due compensation. And do not hold to the marriage bonds of disbelieving women, and ask for what you have spent and let them ask for what they have spent. That is the judgement of Allah; He judges between you. And Allah is Knowing and Wise.”
(Qur’an 60:10)

The verse establishes the basic principle that a believing Muslim woman cannot remain in a valid marital bond with a non-Muslim man.

There is, however, an important distinction that should be made. The question of when exactly the marriage legally ends after a husband's apostasy involves detailed juristic discussion. The scholars have discussed issues such as whether the separation is immediate, whether the wife must observe a waiting period, whether the husband returning to Islam before the end of the waiting period affects the marriage, and whether consummation and other circumstances make a difference. Therefore, it is not appropriate to give a blanket ruling about the exact date or mechanism of separation without knowing the circumstances and referring the matter to a qualified Islamic authority.

The Qur’an also discusses the case of spouses where one party leaves the faith:

Arabic:
وَلَا تُمْسِكُوا بِعِصَمِ الْكَوَافِرِ

Transliteration:
Wa-lā tumsikū bi-ʿi
ṣami al-kawāfir.

English translation:
“And do not hold to the marriage bonds of disbelieving women.”
(Qur’an 60:10)

This demonstrates that the preservation of a valid Islamic marriage is connected to the religious status of the spouses.

Another relevant Qur’anic principle is:

Arabic:
لَا هُنَّ حِلٌّ لَهُمْ وَلَا هُمْ يَحِلُّونَ لَهُنَّ

Transliteration:
Lā hunna
ḥillun lahum wa-lā hum yaḥillūna lahunna.

English translation:
“They are not lawful [wives] for them, nor are they lawful [husbands] for them.”
(Qur’an 60:10)

Therefore, once the husband has genuinely left Islam, he does not retain the ordinary rights of a Muslim husband over his Muslim wife. He cannot demand marital intimacy from her, treat her as his Muslim wife, or insist that she continue living with him as though his change of religion had no legal consequence.

However, this does not mean that he loses every right or every financial entitlement connected with the marriage. His apostasy does not give anyone permission to confiscate property that belongs to him, deny legitimate financial claims without due process, or mistreat him. His rights concerning property, debts, contracts, and other matters must be considered separately according to Islamic law and the applicable legal system.

Similarly, the wife's rights do not simply disappear because her husband has left Islam. Her mahr (bridal gift), unpaid maintenance that was legally due, and other established financial rights must be properly considered. The Qur’an itself mentions returning or settling financial matters in connection with separation:

Arabic:
وَآتُوهُمْ مَا أَنْفَقُوا

Transliteration:
Wa-ātūhum mā anfaqū.

English translation:
“And give them what they have spent [of their bridal gifts].”
(Qur’an 60:10)

The exact financial consequences, however, can depend on the circumstances of the marriage and the applicable school of Islamic jurisprudence. A qualified scholar should therefore examine the specific case rather than assuming that every financial matter has the same ruling.

There is another important issue: the husband should not be casually declared an apostate merely because someone says that he has become a Christian. If the situation is genuine and he has explicitly and knowingly abandoned Islam and embraced another religion, that is a serious matter. But questions of apostasy can involve details concerning what was said, what was intended, knowledge, coercion, misunderstanding, and other circumstances. Individual people should not take it upon themselves to issue grave religious judgements without appropriate knowledge.

If the husband has genuinely announced that he has become Christian, the wife should not be pressured into continuing marital relations with him as though nothing has changed. At the same time, she should avoid unnecessary hostility, insults, or arguments. She should protect her faith and seek knowledgeable guidance concerning the appropriate next step.

If there are children, the situation becomes even more sensitive. Questions concerning their custody, residence, upbringing, maintenance, education, and religious upbringing require separate consideration. The father does not simply cease to be the biological father because he has left Islam, but the Islamic rules governing custody and guardianship can be affected by religious differences. This should therefore be handled by qualified scholars and, where necessary, the appropriate legal authorities, with the welfare and religious protection of the children carefully considered.

The wife should also understand that she is not responsible for forcing her husband back into Islam. She may advise him kindly and invite him to reconsider his decision, but faith cannot be imposed by force.

Allah says:

Arabic:
لَا إِكْرَاهَ فِي الدِّينِ ۖ قَد تَّبَيَّنَ الرُّشْدُ مِنَ الْغَيِّ

Transliteration:
Lā ikrāha fī ad-dīn; qad tabayyana ar-rushdu mina al-ghayy.

English translation:
“There is no compulsion in religion. The right course has become clear from the wrong.”
(Qur’an 2:256)

If the husband sincerely returns to Islam, the situation should again be referred to a qualified scholar because the effect of his return on the marriage depends on the circumstances and the applicable juristic ruling.

Therefore, the safest approach is not for the wife or husband to declare the marriage terminated by themselves without seeking proper Islamic guidance. The wife should approach a qualified and trustworthy scholar, Islamic family court, or recognized Islamic authority and clearly explain what happened: when the husband left Islam, what he said or did, whether the marriage was consummated, whether there are children, whether he is still living with her, and what financial obligations remain.

The husband should also be advised, if there is any possibility of dialogue, to reconsider his decision calmly and seek knowledgeable guidance about Islam rather than making such a serious decision based solely on emotion or misunderstanding.

The Prophet ﷺ said:

Arabic:
مَنْ يُرِدِ اللَّهُ بِهِ خَيْرًا يُفَقِّهْهُ فِي الدِّينِ

Transliteration:
Man yuridillāhu bihi khayran yufaqqihhu fī ad-dīn.

English translation:
“Whoever Allah intends good for, He grants him understanding of the religion.”
(
Ṣaḥīḥ al-Bukhārī, 71; Ṣaḥīḥ Muslim, 1037)

This is a matter in which proper knowledge is particularly important because decisions made hastily can affect marriage, children, finances, inheritance, and family relationships.

In summary, if a Muslim husband genuinely leaves Islam and becomes Christian while his wife remains Muslim, the wife cannot continue a normal marital relationship with him as a non-Muslim husband. He no longer has the ordinary marital rights of a Muslim husband over her. Nevertheless, his other legitimate rights and financial matters should not be ignored, and the wife's established rights, including her mahr and other lawful entitlements, must be protected.

Because the detailed ruling concerning the exact termination of the marriage can differ according to the circumstances and the juristic school followed, the couple should seek a qualified Islamic authority rather than attempting to resolve the legal details themselves.

The wife should protect her faith, avoid unlawful marital relations, maintain dignity and good character, and seek proper guidance. If there is an opportunity to invite the husband back to Islam, this should be done with wisdom, patience, and kindness rather than coercion or abuse.
