A Husband Claims He Did Not Divorce His Wife After the Third Divorce: What Is the Ruling?

QUESTION ❓

Assalamu Alaikum Warahmatullahi Wabarakatuh.

I have a question. My husband divorced me twice, on two separate occasions. Later, we had another disagreement, and he divorced me in front of his mother. He also told her that he had given me the third divorce.

After I returned to my family home, he later went to my father and told him that he had not divorced me. My father asked whether I had witnesses. I told him that his mother and younger siblings were present when it happened.

His mother was contacted by telephone, but she denied that he had divorced me. I swore that he had clearly said in her presence that he had divorced me, and I believe there was then false testimony concerning what happened.

Later, I returned to my husband's home, became pregnant again and gave birth to a baby boy. However, whenever I look at my son, I feel distressed, especially because I remember that his father divorced me and later denied it.

I am now exhausted by this situation and I am beginning to blame myself. What is the Islamic ruling, and what should I do?

May Allah make this matter easy for you and guide everyone involved to the truth and justice.

This is a very serious matter, because if three valid divorces have actually occurred, the legal status of the marriage is fundamentally different from a situation in which the third divorce cannot be established.

However, this case cannot responsibly be decided merely from the summary given here. The exact words used by the husband, the circumstances of each divorce, the timing, whether reconciliation occurred, and the status of the waiting period (`iddah) all need to be examined.

1. Divorce Is a Serious Legal Act

Allah says:

ٱلطَّلَٰقُ مَرَّتَانِ ۖ فَإِمْسَاكٌۢ بِمَعْرُوفٍ أَوْ تَسْرِيحٌۢ بِإِحْسَٰنٍ

Transliteration:
At-ṭalāqu marratāni, fa-imsākum bi-maʿrūfin aw tasrīḥum bi-iḥsān.

Translation:
“Divorce is twice. Then, either retain her in an acceptable manner or release her with good treatment.”

Qur’an 2:229

Divorce is therefore not something to be uttered carelessly during arguments and then treated as though it has no consequences.

If a husband knowingly uses an explicit expression of divorce, such as “I divorce you” or “You are divorced,” it can constitute a divorce. However, the precise circumstances must still be examined, especially where the husband later denies that he made the statement.

2. What If This Really Was the Third Divorce?

If the first and second divorces were valid, and the later statement was genuinely a third valid divorce, then the third divorce is known as ṭalāq al-bā’in al-kubrā (major irrevocable divorce).

Allah says:

فَإِن طَلَّقَهَا فَلَا تَحِلُّ لَهُ مِنۢ بَعْدُ حَتَّىٰ تَنكِحَ زَوْجًا غَيْرَهُ

Transliteration:
Fa-in ṭallaqahā fa-lā taḥillu lahu min baʿdu ḥattā tankiḥa zawjan ghayrah.

Translation:
“Then if he divorces her [for the third time], she is not lawful to him afterward until she marries another husband.”

Qur’an 2:230

Therefore, if three valid divorces have been established, the husband cannot simply say, “I take you back,” and resume marital relations as though nothing happened.

3. But Has the Third Divorce Actually Been Established?

This is the crucial issue in this case.

A qualified scholar or Islamic judicial authority would need to establish, among other things:

  • What exact words did the husband use during the first divorce?
  • What exact words did he use during the second?
  • Were the first and second divorces valid?
  • Did he take her back after either divorce?
  • Was she still within her `iddah when reconciliation occurred?
  • What exactly did he say during the alleged third divorce?
  • Was the statement explicit or ambiguous?
  • Was he conscious and aware of what he was saying?
  • Were the three divorces separate events?
  • What evidence exists concerning the third statement?

These details can materially affect the ruling.

For example, the legal status of an explicit divorce statement is not the same as that of an ambiguous statement, and the circumstances surrounding the statement can also matter.

4. Witnesses and the Husband's Later Denial

The absence of witnesses at the moment of divorce does not necessarily mean that a divorce is invalid. Divorce does not generally depend on witnesses for its validity in the way that some other legal transactions do.

However, when the husband and wife later disagree about whether a divorce occurred, evidence and testimony can become extremely important in determining what happened.

If the husband's mother and siblings were actually present, their testimony should be given honestly and carefully.

Nobody should give false testimony merely to preserve a marriage or protect a family member.

Allah says:

إِنَّ اللَّهَ يَأْمُرُكُمْ أَن تُؤَدُّوا الْأَمَانَاتِ إِلَىٰ أَهْلِهَا وَإِذَا حَكَمْتُم بَيْنَ النَّاسِ أَن تَحْكُمُوا بِالْعَدْلِ

Transliteration:
Inna Allāha ya’murukum an tu’addul-amānāti ilā ahlihā wa idhā ḥakamtum bayna an-nāsi an taḥkumū bil-ʿadl.

Translation:
“Indeed, Allah commands you to render trusts to whom they are due and when you judge between people, to judge with justice.”

Qur’an 4:58

If somebody knowingly gives false testimony concerning such a serious matter, that is a grave sin.

5. What About the Pregnancy and the Child?

The child is completely innocent.

Whatever ultimately happened concerning the marriage, the child must not be blamed, rejected or regarded as a reminder of the parents' dispute.

Allah says:

وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَىٰ

Transliteration:
Wa lā taziru wāziratun wizra ukhrā.

Translation:
“No bearer of burdens will bear the burden of another.”

Qur’an 6:164

Your son did not cause the divorce dispute, the disagreement over testimony, or the subsequent confusion. He should therefore be treated with love, compassion and proper care.

Try to separate your feelings toward the marital conflict from your feelings toward your child. When painful memories arise, remind yourself that your child is not responsible for what happened between you and his father.

6. Should You Blame Yourself?

You should not continually torture yourself with guilt over an issue whose legal status has never been properly determined.

If you genuinely believed that you were still married because your husband denied the divorce and the matter had not been authoritatively settled, you should not simply declare yourself guilty of wrongdoing.

At the same time, because there is now a serious dispute about whether a third divorce occurred, the matter should not be left unresolved.

7. What Should You Do Now?

The most appropriate course is to take the complete case to a qualified scholar or Islamic judicial authority experienced in family law and divorce, preferably one who can hear both sides.

Take all relevant information with you, including:

  1. The exact wording of the first divorce.
  2. The exact wording of the second divorce.
  3. The exact wording of the alleged third divorce.
  4. The dates or approximate times when each occurred.
  5. What happened after each divorce.
  6. Whether the husband performed rujūʿ (reconciliation) and when.
  7. The testimony of people who were present.
  8. Any written messages, recordings or other evidence, if available.

The authority should then determine whether the three divorces actually occurred and what the present marital status is.

Do not continue relying solely on arguments between the two of you about whether the third divorce happened. This is a matter that requires an authoritative determination.

A Final Word

If the third divorce is established as valid, the husband cannot simply resume the marriage by claiming that he has taken his wife back.

But if the third divorce cannot be established, the ruling may be different. This is why the exact facts must be investigated rather than issuing a definitive ruling from one person's account alone.

Most importantly, do not blame your son. He is innocent and deserves your love and care regardless of what ultimately happens between his parents.
